1. Definitions
In these Terms and Conditions, the following terms have the meanings specified:
- "Service" refers to the residential care and related services provided by Gentlebrook
- "Resident" means the individual receiving care services at our facility
- "Family Member" or "Representative" means the authorized person acting on behalf of the Resident
- "Agreement" refers to the care service contract between Gentlebrook and the Resident or their Representative
- "Facility" means the Gentlebrook residential care premises located in Bang Saray, Thailand
- "We," "Us," "Our" refers to Gentlebrook
2. Acceptance of Terms
By using our website, contacting us for information, or entering into a care services agreement, you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or services.
For care services, a separate written agreement will be executed that includes these Terms and Conditions by reference along with specific service details, fees, and schedules.
Residents or their authorized Representatives must be at least 18 years of age and have the legal capacity to enter into binding agreements.
3. Service Description
Gentlebrook provides non-medical residential care services for seniors, including but not limited to:
- Daily comfort assistance with personal care activities
- Garden and wellness activity programs
- Full-service residential living with accommodation and meals
- Safety monitoring and emergency response
- Social and recreational activities
Services are non-medical in nature. We do not provide nursing care, medical treatment, or specialized medical services. Residents requiring medical attention will be referred to appropriate healthcare providers.
Service availability may vary based on Resident needs, staff availability, and facility capacity. We reserve the right to modify service offerings with reasonable notice to current Residents.
4. Admission Requirements
Admission to Gentlebrook requires:
- Completion of an initial consultation and facility tour
- Submission of health information and care needs assessment
- Execution of a written care services agreement
- Payment of applicable fees as outlined in the service agreement
- Designation of emergency contacts and authorized representatives
We reserve the right to decline admission if we determine that we cannot adequately meet a potential Resident's care needs or if admission would compromise the safety or well-being of other Residents.
5. Fees and Payment Terms
Service fees are specified in the individual care agreement and are payable in Thai Baht (THB). Payment terms include:
- Monthly fees are due in advance on the first day of each calendar month
- Accepted payment methods include bank transfer, cash, or check
- Late payments may incur additional charges as specified in the agreement
- Fees are subject to annual review and may be adjusted with 60 days' written notice
- Additional services not included in the base fee will be billed separately
A refundable security deposit may be required upon admission, equivalent to one month's service fee. This deposit will be returned within 30 days of service termination, less any outstanding charges or damages.
Non-payment of fees may result in suspension or termination of services in accordance with Thai law and these Terms.
6. Resident Responsibilities
Residents and their Representatives agree to:
- Provide accurate and complete health information
- Inform staff promptly of any changes in health status or care needs
- Treat staff, other Residents, and visitors with respect
- Follow facility rules and safety protocols
- Maintain personal belongings and respect facility property
- Notify us of planned absences from the Facility
- Ensure timely payment of all fees and charges
- Participate in periodic care plan reviews
Behavior that threatens the safety or well-being of staff or other Residents may result in service termination.
7. Our Responsibilities
Gentlebrook commits to:
- Provide services in accordance with the care agreement and applicable Thai regulations
- Maintain qualified and trained staff to deliver care services
- Ensure a safe, clean, and well-maintained facility environment
- Respect Residents' privacy, dignity, and personal preferences
- Maintain confidentiality of Resident information in accordance with our Privacy Policy
- Provide regular communication with designated Family Members regarding care
- Address concerns and feedback in a timely and professional manner
8. Limitation of Liability
While we take reasonable precautions to ensure Resident safety and well-being, Gentlebrook shall not be liable for:
- Medical conditions or health issues arising from pre-existing conditions
- Personal property loss or damage unless caused by our negligence
- Injuries or incidents resulting from a Resident's failure to follow safety instructions
- Events beyond our reasonable control (force majeure)
- Services provided by third-party healthcare professionals
Our total liability under these Terms shall not exceed the amount of fees paid by the Resident in the 12 months preceding the claim, except as required by Thai law.
9. Termination of Services
By the Resident or Representative:
Either party may terminate the care agreement with 30 days' written notice. The Resident is responsible for fees through the notice period unless an earlier termination is mutually agreed.
By Gentlebrook:
We may terminate services immediately if:
- The Resident's care needs exceed our non-medical service capabilities
- There is non-payment of fees after reasonable notice and opportunity to cure
- The Resident's behavior poses a safety risk to staff or other Residents
- There is a material breach of these Terms or the care agreement
Upon Termination:
All outstanding fees must be paid. Personal belongings must be removed within 7 days. The security deposit will be refunded less any applicable deductions within 30 days.
10. Privacy and Confidentiality
We are committed to protecting Resident privacy and personal information. Our data practices are governed by our Privacy Policy, which forms part of these Terms.

11. Visiting and Communication
Family Members and authorized visitors are welcome during our standard visiting hours (8:00 AM to 6:00 PM daily). Extended or restricted hours may be arranged in special circumstances.
We maintain open communication with designated Family Members through regular updates and are available to address concerns. Emergency situations are communicated immediately to designated contacts.
Visitors must respect Facility rules, other Residents' privacy, and staff instructions. We reserve the right to restrict visiting privileges if necessary to ensure safety and appropriate care.
12. Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of the Kingdom of Thailand. The courts of Chonburi Province shall have jurisdiction over any disputes arising from these Terms or the provision of services.
We encourage resolution of disputes through good-faith discussion. If informal resolution is unsuccessful, disputes may be submitted to mediation before pursuing legal action.
13. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be communicated through:
- Posting updated Terms on our website with a new effective date
- Written notice to current Residents and their Representatives
- Notice posted at the Facility
Continued use of our services after changes are posted constitutes acceptance of the modified Terms. Material changes affecting service delivery or fees will be provided with at least 30 days' notice.
14. General Provisions
Entire Agreement: These Terms, together with the individual care agreement and Privacy Policy, constitute the entire agreement between you and Gentlebrook.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
Assignment: You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms to a successor entity.
